Terms of service

Last updated: October 28, 2026

These Terms of Service ("Terms") apply to every visit to cloverandhearth.com and every order you place with Clover & Hearth. Please read them carefully. By placing an order, you confirm that you have read and accepted these Terms and the policies they refer to.

1. Who we are

Clover & Hearth is a trade name of ERAMODI

  • Chamber of Commerce number: 94555141
  • Email: info@cloverandhearth.com · Phone: [PHONE]

In these Terms, "we", "us" and "our" mean ERAMODI trading as Clover & Hearth. "You" means the person visiting our website or placing an order.

Important: our business address is not a returns address. Never send products to it. See our Return & Refund Policy.

2. Documents that form part of these Terms

The following policies form part of your agreement with us: Shipping Policy, Return & Refund Policy, Cancellation Policy, Payment Policy, Sale & Discount Policy, Privacy Policy and Cookie Policy. If a policy is more generous to you than these Terms, the policy applies.

3. Your consumer rights come first

Nothing in these Terms limits or removes any right you have under the mandatory consumer protection laws of the province or territory where you live. Where those laws give you more protection than these Terms, those laws apply. Every limitation in these Terms applies only to the extent the law allows it.

4. Who can order

You may only order if you are at least the age of majority in your province or territory and able to enter into a binding contract. Our products are sold for personal use only. We may refuse orders that appear to be placed for resale.

5. Products and descriptions

We do our best to describe and photograph every product accurately. Colours can look slightly different depending on your screen, and small variations in measurements (usually 1–3 cm) can occur. Please check the size chart on each product page before ordering. Product images are for illustration; packaging may differ.

6. Prices

  1. All prices are shown in Canadian dollars (CAD), unless your checkout shows another currency.
  2. Shipping to Canada is free.
  3. Import duties and taxes: our parcels are shipped to Canada from outside the country. All import duties, taxes and customs fees are paid by us, so you never pay anything extra at your door. See section 6 of our Shipping Policy.
  4. We may change prices at any time. A price change never affects an order we have already confirmed.
  5. Pricing errors: if a product is listed at an obviously incorrect price because of a technical or human error, we will contact you before shipping. You may then confirm the order at the correct price or cancel it for a full refund. If we cannot reach you within 5 business days, we will cancel the order and refund you in full.

7. How a contract is formed

  1. Your order is an offer to buy. The contract is formed when we send you an order confirmation by email. That email is your copy of the contract; please keep it.
  2. We may refuse or cancel an order, also after confirmation, if: the product is out of stock; there is a pricing or description error; we suspect fraud or unauthorised payment; the delivery address cannot be served; or the order appears to be for resale. If we cancel, we refund everything you paid within 15 days.
  3. An order with several products may arrive in separate parcels.

8. Payment

You can pay with the methods shown at checkout. Payments are processed by Shopify Payments and other secure payment providers; we never see or store your full card details. By paying, you confirm that you are authorised to use the payment method. We may run fraud checks and ask you to verify your identity before shipping. See our Payment Policy.

Payment disputes: if something is wrong with your order, please contact us first; we answer within 2 business days and most problems are solved quickly. This does not affect your legal right to ask your card issuer for a chargeback. If a dispute is opened, we will share our order, shipping and delivery records with the payment provider. If a chargeback turns out to be unfounded, we may refuse future orders and recover our costs where the law allows.

9. Shipping and delivery

  1. Orders are processed within 1–3 business days. Total delivery time is estimated at 7–10 business days from your order date. Your estimated delivery date is shown in your confirmation email.
  2. Orders are prepared by our international fulfilment partners and delivered in Canada by Canada Post.
  3. You are responsible for entering a complete and correct delivery address.
  4. Risk of loss passes to you when the parcel is delivered to the address you gave us.
  5. Full details, including delays, lost parcels and failed deliveries, are in our Shipping Policy.

10. Cancelling an order

Our order system processes orders automatically, so an order cannot be cancelled or changed once it has been placed. If you no longer want your order, please wait until it arrives and return it under our Return & Refund Policy. This does not affect any statutory right to cancel, for example when an order is not delivered within 30 days of the estimated delivery date. See our Cancellation Policy.

11. Returns and refunds

You may return eligible items within 14 days of receipt, under the conditions in our Return & Refund Policy. Return shipping is always paid by you. Returns must be sent to our central returns warehouse, which may be located outside Canada and outside Europe, for example in Asia. The return address is only provided by email after you contact us. Items bought on sale cannot be returned, unless they are defective or incorrect.

12. Damaged, defective or incorrect items

If your item arrives damaged, defective or is not what you ordered, contact us with your order number and photos. We will offer a replacement, a refund or another fair solution, at no cost to you. This does not limit any legal warranty that applies to you.

13. Discount codes and promotions

Discount codes and promotions are subject to our Sale & Discount Policy. Unless stated otherwise, only one code can be used per order, codes have no cash value and cannot be applied to past orders.

14. Using our website

You agree not to: use the website for anything unlawful or fraudulent; place false orders; interfere with the website's security or operation; use bots, scrapers or other automated tools to copy content or prices; or upload anything harmful, offensive or that infringes someone else's rights. We may block access or refuse orders if you break these rules.

15. Reviews and content you send us

If you submit a review, photo or other content, it must be honest and based on your own experience. You give us a free, non-exclusive, worldwide licence to use, display and translate it on our website and social media in connection with Clover & Hearth. We may remove content that is unlawful, offensive or not about our products. We never edit a review to change its meaning.

16. Intellectual property

All content on this website, including the Clover & Hearth name and logo, texts, photos, graphics and design, belongs to us or our licensors and is protected by law. You may not copy, reuse or distribute it without our written permission. See our Intellectual Property Rights page.

We use third parties for hosting, payments, shipping, tracking and analytics. Links to other websites are for convenience only; we are not responsible for their content or practices.

18. Limitation of liability

  1. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, such as loss of income, profit or time, arising from your use of our website or products.
  2. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order.
  3. We are not responsible for delays or failures caused by events beyond our reasonable control (see section 20).
  4. Nothing in these Terms excludes or limits our liability where the law does not allow this, including liability for personal injury caused by our negligence, for fraud, or under any legal warranty that applies to you as a consumer.

19. Your responsibility

To the extent permitted by law, you agree to compensate us for reasonable losses and costs we suffer because you: commit fraud; deliberately misuse our website; or seriously breach these Terms.

20. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as strikes, carrier or customs delays, extreme weather, natural disasters, pandemics, war, government measures or technical outages. If such an event delays your order significantly, we will tell you and you may cancel for a full refund of anything not delivered.

21. Privacy

We process your personal information as described in our Privacy Policy and Cookie Policy.

22. Communication

You agree that we may contact you by email about your order. Marketing emails are only sent if you have given your consent, and you can unsubscribe at any time.

23. Governing law and disputes

  1. These Terms are governed by the laws of the Netherlands. If you are a consumer, this choice of law does not take away the protection of the mandatory laws of the province or territory where you live.
  2. Please contact us first at info@cloverandhearth.com. Most issues are solved quickly by email.

24. Changes to these Terms

We may update these Terms from time to time. The version published on the date of your order applies to that order. Changes never apply to orders already placed.

25. Other provisions

If any part of these Terms is found invalid, the rest stays in force. If we do not enforce a right immediately, we do not give it up. You may not transfer your rights under these Terms to someone else without our consent.
